◆ 부모·형 살해 30대에 무기징역 선고

경기 김포에서 형과 말다툼 후 일가족 3명을 살해한 혐의로 기소된 30대가 무기징역을 선고받았다. 인천지법 부천지원 형사1부(부장판사 여현주)는 24일 선고 공판에서 존속살해 혐의 등으로 구속 기소된 A(36)씨에게 무기징역을 선고했다. 법원은 15년간 전자장치(전자발찌) 부착도 명령했다.

재판부는 "유족들도 원망스럽다고 했지만 피고인이 범행에 이르기까지 상황을 알게 된 뒤 안타깝다는 의견을 냈다"고 밝혔다. 재판부는 "사이코패스 판정 특별검사에서 3.2점으로 재범 위험성이 저위험군으로 분류됐다"고 설명했다.

재판부는 "피고인의 생명을 박탈하기보다 형벌로서 가장 무거운 형을 선고해 사회에서 격리하고 사망한 가족들에게 속죄하는 것이 맞다고 판단했다"고 양형 이유를 밝혔다. 앞서 검찰은 지난 10월 결심 공판에서 A씨에게 사형을 구형했다.

A씨는 지난 7월 10일 오전 11시께 김포 하성면 자택에서 60~70대 부모와 30대 친형을 흉기로 살해한 혐의로 기소됐다. A씨는 당일 오전 11시께 아버지와 형을 먼저 살해했다. 오후 1시께 외출 후 귀가한 어머니도 흉기로 찔러 숨지게 했다.

◆ 범행 전 '정신병 살인' 검색…"우발적 범행" 주장

무직 상태였던 A씨는 당일 자신을 걱정하는 말을 한 부모를 폭행하다가 형에게 맞자 악감정을 품고 범행을 저지른 것으로 조사됐다. 프리랜서 웹 프로그래머로 일하던 A씨는 수입이 끊겨 올 6월부터 가족과 함께 살고 있었다.

A씨는 범행 전 인터넷에 '정신병 살인' 등의 키워드를 검색하는 등 치밀함을 보였다. 그러나 재판 과정에서는 우발적인 범행이었다고 주장했다.

The Criminal Division 1 of the Bucheon Branch of Incheon District Court (Presiding Judge Yeo Hyun-ju) sentenced A (36), who was indicted on charges including murder of lineal ascendants, to life imprisonment at the sentencing hearing on December 24. The court also ordered a 15-year electronic monitoring device (ankle monitor) attachment.

The court stated that "the bereaved family expressed resentment but also sympathy after learning the circumstances that led the defendant to commit the crime." The court explained that "in the psychopath assessment, he scored 3.2 points and was classified as low-risk for recidivism."

The court explained its sentencing reasoning, stating "we determined it is more appropriate to sentence the heaviest punishment to isolate the defendant from society and have him atone to his deceased family members, rather than taking his life." A was indicted for stabbing his parents in their 60s-70s and his brother in his 30s to death with a weapon at his home in Haseong-myeon, Gimpo around 11 a.m. on July 10. A first killed his father and brother around 11 a.m. that day. He then stabbed his mother to death around 1 p.m. after she returned home from an outing.

◆ Searched "Mental Illness Murder" Before Crime…Claims "Impulsive Act"

Investigation revealed that A, who was unemployed, harbored resentment and committed the crime after being struck by his brother while assaulting his parents who had expressed concern about him. A, who had worked as a freelance web programmer, had been living with his family since June this year after his income stopped.

A showed premeditation by searching keywords such as "mental illness murder" on the internet before the crime. However, during the trial, he claimed it was an impulsive act.
