박근혜 정권 당시 국정농단 사건의 핵심 인물 최서원씨(개명 전 최순실)가 더불어민주당 안민석 전 의원을 상대로 낸 손해배상청구 소송 파기환송심에서 일부 승소했다.

21일 법조계에 따르면 서울남부지법 민사항소3-2부(허일승 송승우 이종채 부장판사)는 최씨가 안 전 의원을 상대로 제기한 손해배상청구 소송에서 "피고는 원고에게 2천만 원을 배상하라"고 판결했다. 재판부는 소송비용은 원고가 80%, 피고가 20%를 부담하라고 했다.

재판부는 "피고는 항간에 도는 의혹이나 제삼자 발언을 인용하고도 근거를 명확히 밝히지 않고 직접 조사한 것처럼 말해 원고에 대한 비난 수위가 거세지는 데 일조했다"며 "원고에 대한 수사가 모두 마무리된 지금까지도 발언 내용과 원고의 연관성이 밝혀지지 않았다"고 판결 이유를 밝혔다.

최씨는 2016∼2017년 국정농단 사태 당시 안 전 의원이 방송 등에 출연해 자신의 은닉 재산 문제를 제기하는 등 허위 사실을 유포해 피해를 봤다며 1억 원의 손해배상을 청구하는 소송을 제기했다. 안 전 의원은 최씨의 해외 은닉 재산 규모가 수조 원에 달하며, 독일 내 수백 개의 페이퍼컴퍼니를 이용해 자금세탁을 한다고 주장했다.

Choi Seo-won (formerly Choi Soon-sil), a key figure in the state affairs manipulation case during the Park Geun-hye administration, partially won the remand trial in a damages suit filed against former Democratic Party of Korea Rep. Ahn Min-seok.

According to the legal community on the 21st, the Civil Appeal Division 3-2 of the Seoul Southern District Court (Presiding Judges Heo Il-seung, Song Seung-woo, Lee Jong-chae) ruled in the damages suit filed by Choi against former Rep. Ahn, "The defendant shall compensate the plaintiff 20 million won." The court said the plaintiff shall bear 80% of the litigation costs and the defendant 20%.

The court stated the reason for the judgment, "The defendant contributed to intensifying the level of criticism against the plaintiff by citing suspicions circulating or third-party statements without clearly revealing the basis and speaking as if directly investigated," adding, "The connection between the statements and the plaintiff has not been revealed even now after all investigations of the plaintiff have been completed."

Choi filed a lawsuit claiming 100 million won in damages, saying she suffered damage as former Rep. Ahn appeared on broadcasts during the 2016-2017 state affairs manipulation scandal and spread false facts such as raising issues about her hidden assets. Former Rep. Ahn claimed that the scale of Choi's overseas hidden assets amounted to trillions of won and that she laundered money using hundreds of paper companies in Germany.
