김용민 더불어민주당 의원은 11일 이재명 대통령이 사실적시 명예훼손 조항 폐지 검토를 지시한 데 대해 "법안으로 뒷받침하겠다"고 밝혔다.
국회 법제사법위원회 여당 간사를 맡고 있는 김용민 의원은 이날 페이스북에 게시한 입장문을 통해 "사실적시 명예훼손죄 폐지, 법안 통과까지 완수하겠다"고 밝혔다.
김용민 의원은 "사실적시 명예훼손죄는 진실을 말했더라도 타인의 명예를 훼손한다면 형사처벌이 가능한 조항"이라며 "각종 피해를 폭로한 노동자 등 사회적 약자의 고발 활동을 위축시키고 언론의 감시 기능까지 제약한다는 이유로 이 법에 대한 비판은 꾸준히 제기돼 왔다"고 설명했다.
김용민 의원은 "지난 9월 사실적시 명예훼손죄 규정을 삭제하는 형법 개정안을 이미 대표 발의한 바 있다"며 "표현의 자유를 확대하고, 약자의 입을 막는 법을 바로잡기 위한 입법"이라고 강조했다.
김용민 의원은 "이 법안이 반드시 통과되고 공포될 수 있도록 끝까지 책임있게 추진하겠다"고 덧붙였다.
사실적시 명예훼손 조항은 형법 제307조1항으로, 사실을 표현했더라도 상대방의 명예를 훼손하면 처벌하는 규정이다.

Assemblymember Kim Yong-min, who serves as the ruling party secretary of the National Assembly Legislation and Judiciary Committee, stated through a position statement posted on Facebook that day, "I will complete the abolition of the crime of defamation by true statement and passage of the bill."
Assemblymember Kim Yong-min explained, "The crime of defamation by true statement is a clause that allows criminal punishment if one damages another's reputation even if one told the truth," adding, "Criticism of this law has been steadily raised because it discourages whistleblowing activities by socially disadvantaged people such as workers who exposed various damages and even restricts the media's monitoring function."
Assemblymember Kim Yong-min emphasized, "I already proposed a criminal law amendment to delete the crime of defamation by true statement provision in September," adding, "This is legislation to expand freedom of expression and correct laws that silence the weak."
Assemblymember Kim Yong-min added, "I will responsibly push until the end so that this bill can definitely pass and be promulgated."
The defamation by true statement clause is Article 307, Paragraph 1 of the Criminal Act, a provision that punishes damaging another's reputation even if expressing facts.
