강제추행 혐의로 기소돼 1심에서 징역형의 집행유예를 선고받았던 배우 오영수씨가 항소심에서 무죄를 선고받았다.
11일 수원지법 형사항소6-1부(부장판사 곽형섭·김은정·강희경)는 강제추행 혐의로 기소된 오영수씨의 항소심 선고공판에서 원심을 파기하고 무죄를 선고했다. 오영수씨는 2017년 중반 대구의 산책로에서 피해 여성 A씨를 껴안고, A씨의 주거지 앞에서 볼에 입맞춤하는 등 두 차례에 걸쳐 강제 추행한 혐의로 기소됐다.
재판부는 "피고인은 피해자에게 포옹 동의를 받았을 가능성이 높고, 거절하고 싶다는 피해자 내심의 의사는 표출되지 않은 것으로 보여 강제 추행 고의가 있었는지 여부에 의문이 든다"고 판시했다. 재판부는 "피해자의 예상과 달리 포옹의 강도가 심했다고 강제추행죄가 성립된다고 보기 어렵다"고 밝혔다.
재판부는 "피고인이 피해자에게 부적절한 언행을 했을 가능성은 높으나 공소사실 기재와 같이 강제추행을 했는지는 합리적 의심이 가고 의심스러울 경우 피고인의 이익으로 판단해 유죄 판단을 할 수 없다"고 무죄 이유를 설명했다.
오영수씨는 혐의를 부인했으나 1심 재판부는 유죄로 판단해 징역 8월에 집행유예 2년을 선고했다. 오영수씨 측과 검사 측 모두 항소하며 항소심 재판이 진행됐다.
선고 직후 오영수씨는 취재진에게 "현명한 판결을 해주신 재판부에 경의를 표하며 감사드린다"고 말했다. 피해자 측은 기자회견을 열고 "사법부가 내린 개탄스러운 판결을 성폭력 발생의 구조와 위계 구조를 굳건히 하는 데 일조하는 부끄러운 선고"라며 재판부의 판단에 깊은 유감을 표했다.
넷플릭스 드라마 '오징어게임'에서 '깐부 할아버지'로 주목받은 오영수씨는 한국 배우로는 처음으로 2022년 1월 미국 골든글로브 TV 부문에서 남우조연상을 받았다.

On the 11th, the 6-1st Criminal Appeals Division of Suwon District Court (Presiding Judge Kwak Hyung-seop, Kim Eun-jung, Kang Hee-kyung) overturned the original ruling and acquitted Oh Young-soo, who was indicted on charges of sexual harassment, in the appeal trial sentencing hearing. Oh Young-soo was indicted on charges of forcibly harassing victim Ms. A twice, including hugging her on a walking trail in Daegu in mid-2017 and kissing her cheek in front of her residence.
The court ruled, "There is a high possibility that the defendant received consent from the victim for the hug, and it appears that the victim's inner intention to refuse was not expressed, raising questions about whether there was intent for forced harassment." The court stated, "It is difficult to consider that the crime of forced harassment is established just because the intensity of the hug was stronger than the victim expected."
The court explained the reason for acquittal, stating, "While there is a high possibility that the defendant made inappropriate remarks to the victim, there is reasonable doubt as to whether he committed forced harassment as described in the indictment, and in case of doubt, we cannot make a guilty judgment as it should be judged in favor of the defendant."
Oh Young-soo denied the charges, but the first trial court found him guilty and sentenced him to eight months in prison with a two-year suspended sentence. Both Oh Young-soo's side and the prosecution appealed, leading to the appeal trial.
Immediately after the sentencing, Oh Young-soo told reporters, "I express my respect and gratitude to the court for making a wise decision." The victim's side held a press conference and expressed deep regret over the court's judgment, stating, "The deplorable ruling by the judiciary is a shameful sentence that contributes to solidifying the structure of sexual violence occurrence and hierarchical structure."
Oh Young-soo, who gained attention as the 'Gganbu grandfather' in the Netflix drama 'Squid Game', became the first Korean actor to win the Golden Globe Award for Best Supporting Actor in Television in January 2022.
