피해자들은 단체 또는 개별로 경찰에 고소장을 제출했다. 인천경찰청은 2024년 4월 사건을 배당받아 1년 8개월간 수사를 진행했다. 경찰 관계자는 "개인 피해액이 5억원을 넘어야 특정경제범죄가중처벌법상 사기 혐의가 적용된다"며 "이 사건은 해당 금액을 초과한 피해자가 없어 형법상 사기 혐의를 적용했다"고 말했다.
