경기도에서는 더불어민주당 양문석(안산갑), 이병진(평택을) 의원이 항소심에서 당선 무효형을 선고받고 대법원 확정 판결을 앞두고 있다. 양 의원은 특정경제범죄가중처벌법(사기) 위반으로 징역 1년 6개월, 집행유예 3년을 선고받았으며 공직선거법 위반으로 벌금 150만 원을 추가로 받았다. 2심에서도 원심이 유지됐다.
이병진 의원은 공직선거법 및 부동산실명거래법 위반으로 2심에서 각각 벌금 700만 원, 500만 원을 선고받았다.
송옥주 민주당 의원(화성갑)은 공직선거법 위반(선거구민 물품 제공)으로 징역 1년, 집행유예 2년을 선고받았다. 허종식 민주당 의원(인천 동미추홀갑)은 2021년 전당대회 돈봉투 사건 관련으로 징역 3개월, 집행유예 1년을 선고받고 2심 재판 중이다. 재판 결과에 따라 이 지역도 재보선이 실시될 수 있다.
현역 의원의 지방선거 출마도 변수가 될 수 있다. 내년 2~3월로 예상되는 당내 경선에서 현역 의원이 후보로 확정되면 의원직을 사퇴해야 한다. 더불어민주당 한준호(고양을), 김병주(남양주을) 의원이 경기도지사 출마를 선언하면서 최고위원직을 사퇴했다. 추미애 국회 법제사법위원장(하남갑)은 사퇴 의사를 당 지도부에 전달했고, 염태영(수원무) 의원도 경기지사 출마 후보군으로 거론된다.
이준석 개혁신당 대표(화성을)는 “동탄 주민이 원한다면 출마를 고려하겠다”고 밝혀 경기지사 출마 가능성을 내비쳤다. 박찬대 의원(인천연수갑)의 인천시장 출마도 거론된다.
중앙선거관리위원회에 따르면 내년 4월 30일까지 재보선 사유가 확정되면 지방선거와 동시에 실시된다. 경인지역 재보선 지역 증가가 예상되는 가운데 각 정당은 잠재 후보군 물색에 착수했다.

The constituency of Incheon Gyeyang-B, formerly represented by President Lee Jae-myung, has already been confirmed for a by-election. Additional seats may become vacant if lawmakers facing trials on election-related charges run for local government posts.
Currently, by-elections are confirmed in two regions: Incheon Gyeyang-B and Asan-B in South Chungcheong Province, the constituency of Presidential Chief of Staff Kang Hoon-sik. Nationwide, more than ten by-elections could be held, leading observers to liken the situation to a “mini general election.”
In Gyeonggi Province, Democratic Party lawmakers Yang Moon-seok (Ansan-A) and Lee Byung-jin (Pyeongtaek-B) have received invalidation-level sentences in appellate courts and await final Supreme Court rulings. Yang was convicted of fraud under the Act on the Aggravated Punishment of Specific Economic Crimes and given 18 months in prison with a three-year suspended term, plus a fine of 1.5 million won for violating the Public Official Election Act. The appellate court upheld the original verdict.
Lee was fined 7 million won and 5 million won respectively for violating the Public Official Election Act and the Real Name Transaction of Real Estate Act.
Rep. Song Ok-joo (Hwaseong-A, DP) was sentenced to one year in prison with a two-year suspended term for providing goods to voters. Rep. Democratic Party lawmakers Han Jun-ho (Goyang-B) and Kim Byung-joo (Namyangju-B) resigned from senior party posts to run for Gyeonggi governor. National Assembly Legislation and Judiciary Committee Chair Choo Mi-ae (Hanam-A) has offered her resignation from the committee, while Rep. Yeom Tae-young (Suwon-D) is being mentioned among possible candidates.
Innovation Party leader Lee Jun-seok (Hwaseong-B) said he may consider running for Gyeonggi governor “if Dongtan residents wish so.” Rep. Park Chan-dae (Incheon Yeonsu-A) is also expected to run for Incheon mayor.
According to the National Election Commission, by-elections will be held concurrently with local elections if vacancies are confirmed by April 30. As the number of by-election districts in the capital region is expected to increase, potential candidates are already being discussed in both camps.
For Incheon Gyeyang-B, home district of the president, ruling party spokesperson Kim Nam-jun is being mentioned as a candidate. Former presidential digital communication secretary Kim Nam-guk is reportedly eyeing Ansan-A; he previously represented Ansan-D.
In the opposition, People Power Party Supreme Council member Yang Hyang-ja and former lawmaker Yoo Ui-dong are preparing to run in Pyeongtaek-B, which the party recently designated as a strategic constituency.
If Democratic Party lawmakers are nominated for Gyeonggi governorship, additional by-elections could attract heavyweight political figures.
