◆ 대포폰 사기 일당 8명 전원 집행유예
서울북부지법 형사7단독 김선범 판사는 10일 사기, 범죄단체 가입·활동, 전기통신사업법 위반 등 혐의로 기소된 대출상담책 김모씨에게 징역 1년4개월에 집행유예 3년을 선고했다. 이모씨는 징역 2년에 집행유예 3년, 최모씨는 징역 1년6개월에 집행유예 3년을 선고받았다. 또 다른 김모씨는 징역 1년6개월에 집행유예 3년, 현직 군인 박모씨는 징역 1년2개월에 집행유예 2년을 선고받았다. 박모씨와 이모씨는 각각 징역 1년에 집행유예 2년, 조모씨는 징역 1년2개월에 집행유예 2년을 선고받았다.
◆ "조직적·계획적 범행, 죄질 무거워"
재판부는 "피고인들은 급전이 필요한 피해자들에게 대출해 줄 것처럼 속여 휴대전화와 유심을 편취하고, 소액결제를 이용해 재산상 이익을 취득했다"며 "조직적·지능적·계획적으로 이뤄진 범행으로 죄질이 무겁다"고 지적했다. 재판부는 "피고인들은 공모관계를 인식하며 역할을 분담한 것으로, 공동정범 책임을 회피할 수 없다"고 판단했다. 다만 재판부는 "직접 가담한 피해액이 상대적으로 적고, 피해자 37명이 처벌불원 의사를 밝힌 점 등을 참작한다"고 언급했다.
◆ 피해자 440명에게서 휴대전화 900대 편취
이들은 인터넷 광고를 보고 대출을 문의한 청년·무직자 등에게 '급전 대출이 가능하다'고 속여 휴대전화를 넘겨받은 뒤 소액결제를 여러 차례 진행해 약 15억원을 챙긴 혐의로 재판에 넘겨졌다. 일당은 2020년 11월부터 2021년 3월까지 피해자 440명가량으로부터 휴대전화 약 900대와 유심 1200여개를 받아 대포폰으로 유통한 것으로 조사됐다. 한편 총책 박모씨는 전날 항소심에서 원심 징역 5년보다 감형된 징역 4년6개월을 선고받았다.

Judge Kim Seon-beom of Seoul Northern District Court's 7th Criminal Division sentenced loan consultant Kim, charged with fraud, joining and participating in a criminal organization, and violating the Telecommunications Business Act, to 1 year 4 months in prison with 3 years probation on December 10. Lee received 2 years in prison with 3 years probation, and Choi received 1 year 6 months with 3 years probation. Another defendant Kim received 1 year 6 months with 3 years probation, and active-duty soldier Park received 1 year 2 months with 2 years probation. Park and Lee each received 1 year with 2 years probation, and Cho received 1 year 2 months with 2 years probation.
◆ "Organized and Planned Crime, Serious in Nature"
The court stated, "The defendants deceived victims who needed quick cash by pretending to provide loans, defrauded them of mobile phones and SIM cards, and obtained financial gains through micropayments," adding, "The crime was organized, intelligent, and planned, making it serious in nature." The court determined, "The defendants were aware of the conspiracy and divided roles, and cannot avoid joint principal liability." However, the court mentioned, "We consider that the damage from their direct involvement was relatively small and that 37 victims expressed their wish not to punish them."
◆ 900 Phones Defrauded from 440 Victims
The defendants were indicted for deceiving young people and unemployed individuals who inquired about loans through internet advertisements by claiming 'quick cash loans are available,' then receiving their mobile phones and conducting multiple micropayments to pocket approximately 1.5 billion won. The group was found to have received about 900 mobile phones and over 1,200 SIM cards from approximately 440 victims between November 2020 and March 2021, distributing them as burner phones. Meanwhile, ringleader Park received a reduced sentence of 4 years 6 months in the appeals court the previous day, down from the original 5-year sentence.
