◆ 무기징역 확정, 검찰·피고인 모두 상고 포기

경기 용인시에서 가족 5명을 살해한 50대 A씨에게 무기징역형이 확정됐다. 12일 법조계에 따르면 수원고등법원 형사2-1부(재판장 김민기·김종우·박광서)는 지난달 24일 존속살해 및 살인 혐의로 기소된 A씨에게 무기징역을 선고했다. 검찰과 A씨 측 모두 상고 제기 기한 내에 상고장을 제출하지 않아 판결이 그대로 확정됐다. A씨는 1심 재판에서도 항소하지 않았다. 검찰은 1심과 2심 모두에서 사형을 구형했으나 항소심 판단을 수용했다.

◆ 사업 실패로 수십억 원 채무, 가족 5명 살해

A씨는 2024년 4월 14일 용인시 수지구 한 아파트에서 80대 부모, 50대 배우자, 20대 자녀, 10대 자녀 등 가족 5명의 목을 졸라 살해했다. 범행 직후 A씨는 승용차를 타고 광주시 거주지로 이동해 스스로 목숨을 끊으려 했던 것으로 조사됐다. A씨는 2023년 광주광역시에서 진행하던 민간아파트 신축 및 분양 사업과 관련해 다수의 형사고소를 당했다. 이 과정에서 수십억 원의 채무를 지게 되자 범행을 계획한 것으로 밝혀졌다.

◆ 법원 "사형 정당화할 특별사정 없어"

항소심 재판부는 "피고인의 범행은 차마 입에 담기 어렵지만 2004년 이후 사형이 확정된 15건의 사건을 검토하고 여러 양형 요소를 고려했다"고 밝혔다. 재판부는 "엄중한 형으로 처벌해야 함은 인정되지만 사형에 처하는 것이 정당하다고 볼 수 있는 특별한 사정이 명백히 있다고 보기 어렵다"며 무기징역을 선고했다.

◆ Life Sentence Finalized as Both Prosecution and Defendant Waive Appeal

A man in his 50s, identified as Mr. A, who killed five family members in Yongin, Gyeonggi Province, has been sentenced to life imprisonment. According to the legal community on the 12th, the Suwon High Court Criminal Division 2-1 (Presiding Judge Kim Min-ki, Kim Jong-woo, Park Gwang-seo) sentenced Mr. A to life imprisonment on the 24th of last month on charges of parricide and murder. The sentence was finalized as neither the prosecution nor Mr. A's side filed an appeal within the deadline. Mr. A did not appeal the first trial verdict either. The prosecution sought the death penalty in both the first and second trials but accepted the appellate court's decision.

◆ Business Failure Led to Billions in Debt, Murder of Five Family Members

Mr. A strangled five family members to death on April 14, 2024, at an apartment in Suji-gu, Yongin. The victims included his parents in their 80s, his spouse in their 50s, one child in their 20s, and another in their 10s. After the crime, Mr. A drove to his residence in Gwangju and attempted to take his own life, according to the investigation. Mr. A faced multiple criminal complaints in 2023 related to a private apartment construction and sales project in Gwangju Metropolitan City. The investigation revealed that he planned the crime after incurring debts amounting to billions of won.

◆ Court Rules "No Special Circumstances to Justify Death Penalty"

The appellate court stated, "The defendant's crime is almost unbearable to mention, but we reviewed 15 cases where death sentences were confirmed since 2004 and considered various sentencing factors." The court added, "While it is acknowledged that severe punishment is necessary, it is difficult to find clear special circumstances that would justify imposing the death penalty," explaining the life sentence decision.
