◆ 윤 전 대통령 4개월 만에 법정 출석
곽종근 전 육군 특수전사령관이 2025년 10월 30일 윤석열 전 대통령의 내란 혐의 재판에 증인으로 출석했다. 서울중앙지법 형사합의25부(부장판사 지귀연)는 이날 윤 전 대통령의 내란 우두머리 등 혐의 재판을 진행했다. 지난 7월 10일 재구속 후 16회 연속 불출석하던 윤 전 대통령은 약 4개월 만에 법정에 나왔다.
◆ 국회 의원 강제 진입 지시 증언
곽 전 사령관은 비상계엄 당시 윤 전 대통령으로부터 "문짝을 부숴서라도 안에 있는 의원들을 끌어내라"는 지시를 받았다는 증언을 재확인했다. 특검팀이 "윤 전 대통령이 문짝을 부수고 의원들을 끄집어 내라고 지시했느냐"고 묻자 "네"라고 답했다. 곽 전 사령관은 비상계엄 선포 당일인 지난해 12월 3일 오후 11시36분, 다음날 0시31분 두 차례 통화했으며 두 번째 통화에서 이같은 지시를 받았다고 증언했다.
◆ 10월부터 비상대권 언급, 핵심 증거 될 듯
곽 전 사령관은 윤 전 대통령이 지난해 10월부터 '비상대권'을 언급했다고 증언했다. 지난해 10월 1일 저녁 자리에서 "확보해야 할 장소, 비상대권, 특별한 방법 등이 그때부터 기억 속에 있다"고 말했다. 11월 9일에는 윤 전 대통령이 "특별한 방법이 아니고선 해결할 방법이 없다"고 말했다고 증언했다. 곽 전 사령관의 진술이 일관되고 구체적일 경우 내란 우두머리 혐의의 유무죄를 가릴 핵심 증거가 될 것으로 보인다.
