보험설계사 등록자격시험에 대리 응시한 혐의로 기소된 현직 보험설계사에게 벌금형이 선고됐다.
인천지법 형사10단독 황윤철 판사는 25일 업무방해 및 공문서부정행사 혐의로 기소된 보험설계사 A(60·여)씨에게 벌금 700만원을 선고했다고 밝혔다.
법원은 같은 혐의로 기소된 보험설계사 자격 취득 준비자 B(64·여)씨에게도 벌금 700만원을 선고했다.
A씨는 지난해 8월 13일 오전 서울의 보험설계사 등록자격시험장에서 B씨의 주민등록증을 시험감독관에게 제시한 뒤 시험에 응시했다. 이로 인해 공문서를 부정하게 행사하고 생명보험협회의 시험 관리 및 감독 업무를 방해한 혐의를 받았다.
A씨는 범행 전날 저녁 무렵 위경련 통증을 겪던 B씨로부터 대리응시 부탁을 받고 이를 수락한 것으로 조사됐다.
황 판사는 "피고인들에게 범죄 경력이 없는 점과 업무방해의 정도 등을 고려했다"고 양형 이유를 밝혔다.

A current insurance planner who took a registration qualification exam on behalf of another person was sentenced to a fine.
Judge Hwang Yoon-cheol of the Criminal Division 10 of Incheon District Court announced on the 25th that he sentenced insurance planner A (60, female) to a fine of 7 million won for obstruction of business and illegal use of public documents.
The court also sentenced B (64, female), a person preparing to obtain insurance planner qualifications who was indicted on the same charges, to a fine of 7 million won.
A presented B's resident registration card to the exam supervisor at an insurance planner registration qualification exam site in Seoul on the morning of August 13 last year and took the exam. She was indicted for illegally using public documents and obstructing the Life Insurance Association's exam management and supervision duties.
A was investigated to have accepted a request for proxy test-taking from B, who was suffering from gastritis pain around the evening before the crime.
Judge Hwang stated the sentencing reason, "We considered that the defendants have no criminal record and the degree of business obstruction."
