◆ 검찰 사형 구형

인천지법 형사13부(부장판사 김기풍)는 8일 결심공판을 열었다. 검찰은 A(62)씨에게 사형을 구형했다. A씨는 살인, 살인미수, 총포·도검·화약류 등의 안전관리에 관한 법률 위반, 현주건조물방화미수 혐의로 구속 기소됐다. 검찰은 구형 사유로 ▲친아들을 치밀한 계획하에 살해한 점 ▲추가 살인을 예비한 점 ▲자택에 폭발물을 설치해 대량 인명피해 가능성이 있었던 점 ▲죄질이 극악하고 참작 사유가 없는 점을 밝혔다. 선고공판은 내년 2월 6일 오후 인천지법에서 열린다.

◆ 사건 경위

A씨는 7월 20일 오후 9시 30분께 인천 연수구 송도동 아들 B(34)씨의 아파트에서 사제총기를 두 차례 발사해 아들을 살해했다. A씨는 범행 직후 밖으로 도망치던 독일 국적 가정교사를 향해 총기를 두 차례 격발했다. 총탄이 도어록에 맞거나 불발돼 살인미수에 그쳤다. A씨는 집 안에 있던 며느리와 손주 2명을 위협하던 중 며느리가 경찰에 신고하는 소리를 듣고 서울로 도주했다. 경찰은 약 3시간 만에 A씨를 긴급체포했다. 경찰은 A씨의 서울 도봉구 쌍문동 주거지에서 시너가 담긴 페트병 등 인화성 물질과 점화장치를 발견했다. A씨는 범행 이튿날 정오로 맞춰진 발화 타이머를 설치해 방화를 시도한 혐의로도 기소됐다.

◆ 범행 동기

A씨는 과거 성폭력 범행으로 이혼한 뒤 일정한 직업 없이 전처와 B씨로부터 매달 지원을 받아 생계를 이어왔다. 전처와 B씨는 이중 지원 사실을 알고 2023년 말부터 경제적 지원을 끊었다. A씨는 유흥비와 생활비가 부족해지자 복수를 결심한 것으로 파악됐다. 지난 9월 열린 첫 재판에서 A씨는 아들 살해 혐의는 인정했다. 다만 며느리와 손주 2명, 독일인 가정교사 살해 미수 혐의와 방화 미수 혐의는 부인했다.

◆ Prosecutors Seek Death Penalty

The 13th Criminal Division of Incheon District Court (Presiding Judge Kim Gi-pung) held a final trial on Dec. 8. Prosecutors sought the death penalty for A (62). A was indicted on charges of murder, attempted murder, violations of the Act on Safety Management of Guns, Swords, Explosives, etc., and attempted arson of an occupied structure. Prosecutors cited the following reasons: ▲A killed his own son through meticulous planning ▲A prepared for additional murders ▲A installed explosives at his home, risking mass casualties ▲The crime is heinous with no mitigating circumstances. The sentencing trial will take place at Incheon District Court on the afternoon of Feb. 6 next year.

◆ Case Details

A fired a homemade gun twice and killed his son B (34) at B's apartment in Songdo-dong, Yeonsu-gu, Incheon, at around 9:30 p.m. on July 20. A fired twice at a German tutor who fled outside immediately after the crime. The bullets hit the door lock or misfired, resulting in attempted murder. A threatened his daughter-in-law and two grandchildren inside the home. A fled to Seoul after hearing his daughter-in-law call police. Police arrested A approximately three hours later. Police discovered plastic bottles containing thinner and other flammable materials and an ignition device at A's residence in Ssangmun-dong, Dobong-gu, Seoul. A was also indicted for attempting arson by installing a fire timer set for noon the day after the crime.

◆ Motive

A divorced after committing sexual violence and lived without steady employment. A received monthly support from his ex-wife and B. His ex-wife and B discovered the dual support and cut off financial assistance from late 2023. A decided to seek revenge when funds for entertainment and living expenses ran short. At the first trial in September, A admitted to killing his son. However, A denied charges of attempted murder of his daughter-in-law, two grandchildren and the German tutor, as well as attempted arson.
