군 휴가 복귀 당일 교통사고를 당한 것처럼 부대에 거짓말해 휴가를 연장받은 20대 남성이 실형을 선고받았다. 인천지법 형사18단독(판사 윤정)은 29일 근무기피목적위계 및 위계공무집행방해 혐의로 기소된 A(23)씨에게 징역 4개월을 선고했다고 밝혔다.
A씨는 지난해 8월 12일 오후 7시께 서울 도봉구 일원에서 지휘관인 포대장 B대위에게 전화를 걸었다. A씨는 "교통사고를 당해 수술 및 입원을 해야 하니 휴가를 추가해 달라"고 거짓말했다. A씨는 1일 휴가 연장 승인을 받아 근무를 기피할 목적으로 위계를 부렸다. A씨는 B대위의 인사관리에 관한 직무집행을 방해한 혐의로 기소됐다. A씨는 범행 당일 자정까지 부대에 복귀해야 했다. A씨는 여자친구와 시간을 보내다가 부대에 복귀하고 싶지 않아 교통사고를 당한 것처럼 B대위를 속여 휴가를 연장하기로 마음먹었다. 범행을 공모한 A씨의 여자친구는 병원 간호사인 척 가장해 B대위에게 "교통사고로 A씨의 허리 인대가 늘어나고 무릎의 물혹이 터져 수술과 입원이 필요하다"고 말했다.
윤 판사는 "이 사건 각 범행은 군 기강을 해이하게 하고 병역의무를 성실히 수행하고 있는 장병들의 사기를 저하하는 것으로서 그 죄책이 가볍지 않다"고 판시했다. 윤 판사는 "A씨에게 벌금형을 초과하는 형사처벌을 받은 전력은 없었던 것으로 보이는 점 등을 참작했다"고 양형 이유를 밝혔다.

Judge Yoon ruled "Each crime in this case undermines military discipline and lowers the morale of soldiers who are faithfully fulfilling their military service obligations so the culpability is not light." Judge Yoon explained the sentencing reason saying "We took into consideration that A appears to have no prior criminal record exceeding a fine."
