황교안 전 총리

내란 특검이 내란 선동 등 혐의를 받는 황교안 전 국무총리의 신병 확보에 나섰지만 법원에서 받아들여지지 않았다.

14일 법조계에 따르면 박정호 서울중앙지법 영장전담 부장판사는 4시간 30분에 걸쳐 황교안 전 총리의 구속 전 피의자 심문을 진행하고 구속의 필요성이 부족하다며 구속영장을 기각했다. 박 부장판사는 도주나 증거인멸의 염려 등 구속 사유에 대해서도 소명이 부족하다며 객관적인 사실관계에 대해서는 증거가 상당 부분 수집된 것으로 보인다고 밝혔다.

황교안 전 총리는 12·3 비상계엄 선포 직후 페이스북에 우원식 국회의장을 체포하라, 대통령 조치를 정면으로 방해하는 한동훈 국민의힘 대표도 체포하라 등의 게시글을 올려 내란을 선동했다는 혐의를 받는다. 특검은 황 전 총리의 구속영장에 내란 선동 혐의 외에도 공무집행방해, 내란 특검법 위반 혐의도 담았다. 황 전 총리가 영향력을 활용해 영장 발부 판사의 이름을 알아내고 이를 공개해 사법 질서를 훼손했다는 특검의 주장도 포함됐다.

특검은 지난 12일 황 전 총리의 자택을 압수수색하는 한편 체포영장도 집행했다. 황 전 총리는 특검 조사에서 대부분 질문에 진술 거부권을 행사한 것으로 파악됐다. 특검은 황 전 총리를 상대로 추가 조사를 벌여 구속영장을 재청구하는 방안 등을 검토할 것으로 보인다.

The Insurrection Special Prosecutor's Office attempted to secure custody of former Prime Minister Hwang Kyo-ahn, who is suspected of insurrection incitement and other charges, but the court did not accept it.

According to the legal community on the 14th, Park Jung-ho, a warrant-dedicated chief judge at the Seoul Central District Court, conducted a pre-arrest suspect interrogation of former Prime Minister Hwang for 4 hours and 30 minutes and dismissed the arrest warrant, saying "there is insufficient necessity for arrest." Judge Park stated that "there is also insufficient evidence for reasons for arrest such as concerns about flight or destruction of evidence" and "it appears that evidence has been substantially collected regarding objective facts."

Former Prime Minister Hwang is suspected of inciting insurrection by posting on his Facebook immediately after the December 3 emergency martial law declaration, saying "Arrest National Assembly Speaker Woo Won-shik. Also arrest People Power Party Leader Han Dong-hoon, who is directly obstructing the President's measures." The Special Prosecutor's Office included charges of obstruction of official duties and violation of the Insurrection Special Prosecutor Act in addition to insurrection incitement charges in former Prime Minister Hwang's arrest warrant. The Special Prosecutor's claim that former Prime Minister Hwang used his influence to find out the name of the judge who issued the warrant and disclosed it, undermining judicial order, was also included.

The Special Prosecutor's Office searched and seized former Prime Minister Hwang's residence on the 12th and also executed an arrest warrant. Former Prime Minister Hwang was found to have exercised his right to refuse to testify on most questions during the Special Prosecutor's investigation. The Special Prosecutor's Office is expected to consider conducting additional investigations on former Prime Minister Hwang and re-requesting an arrest warrant.
